Terms of Service — LusoChat

These Terms of Service ("Terms") govern your use of the LusoChat app and the lusochat.com website (the "Service"), provided by Inventa Melhor ("we", "us"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility & accounts

You must be at least 13 years old (or the minimum age of digital consent in your country) to use LusoChat. You can sign in with Apple or use the app as an anonymous guest. You are responsible for activity that occurs under your account and for keeping your device secure.

2. The Service

LusoChat lets you chat with a curated selection of third-party AI models through a single native app. The available models, features, and limits may change over time as we improve the Service. We do not guarantee that any particular model will always be available.

3. Usage limits

The free plan includes a set number of messages per calendar month (currently 1,000), enforced on our servers and reset at the start of each month. We may adjust limits, introduce paid plans, or apply fair-use protections to keep the Service available to everyone. You may not attempt to circumvent these limits or our abuse-prevention measures.

4. Acceptable use

You agree not to use the Service to:

break the law, infringe others' rights, or generate harmful, abusive, or deceptive content;
attempt to access, reverse-engineer, or extract our keys, credentials, or backend systems;
interfere with, overload, or disrupt the Service, or use automated means to abuse it;
violate the usage policies of the underlying model providers.

We may suspend or terminate access that violates these Terms or that threatens the Service or other users.

5. Your content

You retain ownership of the prompts and files you submit and, to the extent permitted by law, of the outputs you receive. You grant us the limited rights needed to operate the Service — for example, to transmit your prompts to model providers to generate responses, and to store your conversations so they sync across your devices. You are responsible for your content and for ensuring you have the rights to submit it.

6. AI-generated output

Responses are produced by third-party AI models and may be inaccurate, incomplete, or out of date. Output does not constitute professional, legal, medical, or financial advice. You are responsible for reviewing and verifying any output before relying on it. Different users may receive different responses to the same prompt.

7. Intellectual property

The LusoChat app, website, branding, and design are owned by Inventa Melhor and protected by applicable laws. These Terms do not grant you any rights to our trademarks or to the names and trademarks of the third-party models featured in the app, which belong to their respective owners.

8. Subscriptions & payments

We may offer optional paid plans (such as "LusoChat Pro") in the future. Any purchases would be processed by Apple through your App Store account, subject to Apple's terms, with pricing and billing shown at the point of purchase. Subscriptions renew until cancelled in your App Store settings.

9. Disclaimers & limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will meet your expectations.

To the maximum extent permitted by law, Inventa Melhor will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms or if required to protect the Service. Provisions that by their nature should survive termination will continue to apply.

11. Changes

We may update these Terms from time to time. When we make material changes, we'll update the date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply.
